TAPP Urges Congress to Pass the Promoting and Respecting Economically Vital American Innovation Leadership Act

Tomorrow, the Senate Judiciary Committee will hold a mark-up on the Promoting and Respecting Economically Vital American Innovation Leadership (PREVAIL) Act. As TAPP has said in the past, the PREVAIL Act, and similar legislation, is critical to the promotion of American innovation and the maintaining of our technological edge over foreign adversaries like China.

The PREVAIL Act aims to reform several Patent Trial and Appeal Board (PTAB) practices. According to U.S. Patent and Trademark Office (USPTO) data, the PTAB invalidates more than 70% of all patent claims. This kind of behavior discourages inventors and prevents innovation from progressing. The PREVAIL Act would improve PTAB efficiency and transparency, therefore promoting innovation and competitiveness amongst inventors.

As foreign competition like China continues to advance its innovation, the United States must not hinder our inventors with excess regulations and inefficient processes. TAPP supports the PREVAIL Act and urges Congress to do the same.
